Remove default Mgs Softkey with mwi

I have created an EFK to use for message retrieval and mailbox management.  It is always present on the idle and dialtone screens.  When a message arrives the light comes on and I get another messages softkey added to my display.  This is the default behavior.  Anytime I enable message waiting notification this softkey comes back.

  How do I either

1) make the default Mgs softkey present on the screen even when mwi = 0 (idle and dialtone states) or

2.) disable the mwi driven Mgs key?

current settings are:

up.oneTouchVoiceMail="0"

msg.mwi.{$line}.subscribe="1"
msg.mwi.{$line}.callBackMode="disabled"
msg.mwi.{$line}.callBack="*97"

up.mwiVisible="1"

message waiting indication works, but adds the key.  If I set up.mwiVisible="0" I don't see either.

I cannot reproduce this using UCS 4.0.3 Rev F but have not really looked to deep into this.

Voicemail icons are only displayed on the line keys but no additional button.

Thank you for your help, I appreciate the time.

When I said "If I set up.mwiVisible="0" I don't see either" I meant that I don't see the duplicate softkey, but nor do I recieve a message waiting notification(light and warble).  These are both softkeys, I just want my softkey to be the only visible one, ever. 

Optionally, if I could by make the phone's own Mgs softkey visible even when there were not a message waiting, that would work as well.
